  3. Shipments: This is where you can check your previous shipments and requests and arrange them.
  4. Logistics maps: This is a place for you to check the availability of existing available transport, either ships, or trucks and wagons, as a latest posts of trending carriers.
  5. Customer Control Panel: This is where you can manage your bookings, invoices, any documentation concerned, see full picture of your shipments and finance information. Easily create new bookings from this menu and deliver them to your favorite carriers.
  6. Track and Trace: This tool shows you information about position of your shipments in current moment of time.
  7. My Products: This is where you can add and manage any products that you wish to be added and displayed on our website. If you are a member of VIP Shippers Club – you can promote your products on SeaRates and hundreds affiliated websites and get many other features to raise your sales.
  8. My Apps: This is where you can check the various applications of SeaRates, which you have subscribed to or purchased.
  9. Managers: Here you can see, add, edit and remove managers in your Company who should have access to the system and arrange your business processes.
  10. Calendar: An essential tool synchronized with Google Calendar to add and manage events to make the most of your time here.

THIS PUBLIC AGREEMENT made BETWEEN: SEARATES LTD represented by Gilmore Mercieca, having its principal office at Malta, (hereinafter referred to as the “SEARATES”), AND your Company, according to documents and information uploaded to your personal account at www.searates.com, (hereinafter referred to as the “CUSTOMER”), with respect to rendering logistics services and transportation of foreign trade goods, together “Parties“, everyone “Party“, accepted this agreement as follows.

The subject of the present Agreement is international marine intermodal carriage of the Customer’s clients’ foreign trade cargoes.

Under this contract, the Customer agrees with the general provisions and procedures for making quotations on his freight requests, as well as the algorithm for the actual transportation of each of his cargo.

2.1. The Forwarding Agent of the Contractor will undertake to fulfill the carriage of the Customer’s cargoes according to the written instructions of the Customer on the mutually agreed rates, terms and.

2.2. Payment (freight) and any other due rates and fees for carriage of the cargoes for each separate carriage will be set up according to the Forwarding Agent rates in force at the moment of the beginning of the carriage and will be fixed in the corresponding invoices of te Forwarding Agent.

3.1. CUSTOMER confirms and agrees with the provisions of this Agreement that the number of Agents and their location in one area are not specified and can be managed at the discretion of SEARATES.

3.2. CUSTOMER has the opportunity to communicate with the best local SEARATES agents. After agreeing on the detailed information on the delivery (price, date of loading, delivery time, cargo characteristics, demurrage, special conditions, etc.) in the SeaRates Chat it will be possible to confirm to the Agent his offer.

3.3. AGENT is not allowed to send phone/email or other contact information in the chat; any information about his company or hidden advertising, until the CUSTOMER accepts the offer.

3.4. Each chat is stored in the SEARATES system to improve customer support.

3.5. All payments are received directly to the Contractor's Agent, incl. in its national or other currency.

3.6. CUSTOMER should not transfer his contact details in the chat until the Agent provides a quotation. In any case, the CUSTOMER will be denied any other form of communication until the moment when he accepts the price offer of the Agent.

3.7. CUSTOMER must act strictly in accordance with the terms and conditions of this Agreement applicable to him. Violation of the rules, unfair or suspicious activity leads to suspension or blockage of the CUSTOMER profile, and in the end - to the termination of the contract.

3.8. The algorithm of the CUSTOMER's work in the SeaRates Chat

  1. accept a public agreement
  2. upload company documents (registration certificate, VAT payer certificate), enter bank details
  3. communicate in a chat with the Agent before sending the price offer, clarify all the necessary questions
  4. if the CUSTOMER does not answer in the chat, the server will automatically make a call to his phone with the message "You are waiting for the manager in the chat to complete the transaction." If you can not enter the chat right now - press 1. In this case, after your return to the chat later the manager will be notified automatically
  5. after clarifying all the issues and accepting the Agent's price offer, it is allowed to exchange contact information. The transaction will be assigned a unique booking number, which can be tracked in the SeaRates system, and it will also be the bill of lading number for this transaction
  6. in your Control Panel (and also the Agent on his Panel), a transaction will automatically be created for this shipment, to which the draft of the bill of lading will be attached (Appendix 2 to this contract) and invoice will be automatically created and sent to you on the e-mail for prepayment (Appendix 1 to this contract)
  7. after the transportation is completed. The chat remains open and you can leave a feedback about the service of the Agent that will be visible to other Shippers. Each completed transaction increases your ranking as an active shipper for SeaRates and attract best Agents with the highest ranking to quote you

4.1. The Forwarding Agent will fulfill:

  • carriage by sea according to the written instructions of the Customer;
  • release of an empty container for the Customer’s loading;
  • unloading a container loaded with the Customer’s cargo from the truck;
  • loading of the ordered container on board the nearest vessel in the port of shipment;
  • unloading the container from the last vessel in the port (ports) of destination;
  • inland hauliage;
  • other modes of delivery and services.

5.1. Customer via e-mail will inform the Forwarding Agent of the estimated date of shipment and quantity of the shipped cargo in due time at least within 7 days to the planned shipment.

5.2. The Customer will procure fulfillment of any necessary customs procedures in the place of unloading.

5.3. In case of any unforeseen consequences the Customer will be obliged to phone to the Forwarding Agent.

5.4. The Customer will be obliged to present to the Forwarding Agent the documents required to forward the container in the ports of shipment/unshipping.

5.5. The Customer shall pay freight, cargo handling costs and any other mutually agreed payments due to the Forwarding Agent for any and all associated services and works rendered in respect to carriage and handling/ processing of the cargoes according to the tariffs of the Forwarding Agent.

6.1. Сustomer is obliged to prepay for the services provided in a currency agreed with the Contractor's Agent in the chat room. If another currency is not agreed, by default payment in US dollars or Euros is made in 100% amount of the invoiced by the Contractor's Agent. The Сustomer bears all costs associated with bank transfer and any costs in favor of a third party.

Fragen zu unserem Service

7.1.1. A party which engaged the third party to fulfil its obligations under the present Agreement will be responsible to the other party of the Agreement for non-fulfillment or improper fulfillment of the obligations by this third party as for its own acts.

7.1.2. In case of non-fulfillment or improper fulfillment of the obligations under the Agreement by any party, the party at fault will be obliged to recover direct losses born by the other party.

7.2. Liability of the Contractor

7.2.1. Material and legal liability of the Contractor shall be regulated by the corresponding terms and conditions.

7.3. Liability of the Customer

7.3.1. The Customer will be responsible for correct paper works, timely provision to the Forwarding Agent of any required information. In case through the Customer’s fault a container is standing idle in the port or elsewhere, the Customer shall be liable and will pay a fine for the downtime (demurrage) according to the tariffs of the Forwarding Agent. Accordingly this fine will be considered as the integral part of the standard carriage by sea and increase the total amount due to the Forwarding Agent.

8.1. The Contractor may further at its option choose that this Agreement shall be subject to (i) the Law and jurisdiction of the competent court at Customer’s principle place of business, or that of any of its Subsidiaries, or (ii) the law of Customer’s principle place of business, or that of any of its Subsidiaries and arbitration in accordance with such law.

9.1. The present Agreement will come into legal effect from the moment of its undersigning and will be valid without time limitations.

9.2. Any changes and alterations to the present Agreement will be its integral parts and valid only in case they are executed in written confirmation and undersigned by the authorized persons of the both parties.
